DEFINITIONS: From here forward, the term “OWNER” will refer to the owner, part-owner, or lessee of animal(s) contracted under this agreement. The terms “HORSE(S)” and “ANIMAL(S)” will refer to all equine species and the animal to which this agreement refers. The term “VOLUNTEER(S)” will from here forward refer to any person(s) assisting the trainer or facility of LASTING IMPRESSION HORSEMANSHIP, LLC. The term “TRAINER(S)” shall refer to LASTING IMPRESSION HORSEMANSHIP, LLC’S trainer(s), volunteers, or employees employed by said company. The terms “TRAIN” and “TRAINING” shall refer to schooling, conditioning and education of said horse. “HORSEBACK RIDING”, “HORSE LESSONS”, or “HORSE CLINICS“ will refer to riding and handling of horses whether from the ground or mounted. The term “RIDER” or “PARTICIPANT” shall refer to a person who handles or comes near a horse from the ground or mounted. The term “I”, “ME”, “MY” will refer to OWNER(S) and or HORSEBACK RIDER(S) and the parents or legal guardians of said minor. The term “PREMISES”, “FACILITY”, “FARM”, and “RANCH” shall refer to the facility where the clinic is held, and any employee(s) or volunteers.
Agreement Scope and Territory: The following agreement is legally binding between LASTING IMPRESSION HORSEMANSHIP, LLC, and Owner and/or Owner’s parents or legal guardians, should Owner be a minor, when signed by parties. The agreement will be interpreted and enforced under the laws of Michigan. If any clause, phrase, or word conflicts with state law then that single part is null and void.
AGREEMENT PURPOSE: At the beginning of this agreement the OWNER intends to:
___X___ Participate in an equine clinic from the OWNERS own provided horse, or horse provided by TRAINER. This may be from both the ground or mounted.
___X___ Inherit all risk associated with any and all activities with or without presence of TRAINER, use of any horse, or injury incurred while on PREMISE.
RISK ASSOCIATED WITH EQUINE ACTIVITIES: I undersigned, understand and acknowledge the innate risk associated with equine activities and assumes all risk associated with participation in said activities. Such risk includes but is not limited to the possibility of equines to behave in ways including, bucking, bolting, biting, kicking, sidestepping, rearing, falling, flipping over, or stepping on that may result in injury, harm, or even death in persons mounted or around them. It is not uncommon for horses to react in such a manner to sounds, movements, objects, people, or other animals. Certain hazards such as footing, surface, and subsurface conditions; collisions with other animals or objects; the potential participant loses balance or acts in a negligent manner; failing to maintain control over animal or not acting within riders’ ability; may contribute to injury of participant or others. The RIDER understands that a horse is naturally unpredictable and may divert from its training causing it to react on its survival instincts of fight or flight. RIDER assumes all risk associated with and waives any claims for injury, loss, or death corresponding to said activities. RIDER further acknowledges that the behavior of any animal is correlated to some extent with the ability of the RIDER. RIDER assumes all risks and warrants full and fair disclosure of abilities to TRAINER.
