The agreement will be interpreted and enforced under the laws of Michigan. If any clause, phrase, or word conflicts with state law then that single part is null and void.

AGREEMENT PURPOSE: At the beginning of this agreement the OWNER intends to:

___X___ Participate in an equine clinic from the OWNERS own provided horse, or horse provided by TRAINER. This may be from both the ground or mounted.

___X___ Inherit all risk associated with any and all activities with or without presence of TRAINER, use of any horse, or injury incurred while on PREMISE.

RISK ASSOCIATED WITH EQUINE ACTIVITIES: I undersigned, understand and acknowledge the innate risk associated with equine activities and assumes all risk associated with participation in said activities. Such risk includes but is not limited to the possibility of equines to behave in ways including, bucking, bolting, biting, kicking, sidestepping, rearing, falling, flipping over, or stepping on that may result in injury, harm, or even death in persons mounted or around them. It is not uncommon for horses to react in such a manner to sounds, movements, objects, people, or other animals. Certain hazards such as footing, surface, and subsurface conditions; collisions with other animals or objects; the potential participant loses balance or acts in a negligent manner; failing to maintain control over animal or not acting within riders’ ability; may contribute to injury of participant or others. The RIDER understands that a horse is naturally unpredictable and may divert from its training causing it to react on its survival instincts of fight or flight. RIDER assumes all risk associated with and waives any claims for injury, loss, or death corresponding to said activities. RIDER further acknowledges that the behavior of any animal is correlated to some extent with the ability of the RIDER. RIDER assumes all risks and warrants full and fair disclosure of abilities to TRAINER.

RIDING HELMET WARNING: RIDER/OWNER is warned by TRAINER that anyone handling horses is strongly encouraged to wear properly fitted and secured protective headgear (equestrian approved riding helmet). Wearing of such headgear while mounting, riding, dismounting and being around horses, may prevent or reduce severity of some head injuries and may prevent death from happening as result from a fall or other occurrence.

DIRECT LOSS TO PERSONAL PROPERTY WARNING: OWNER is warned that while on PREMISE loss, damage, theft, or injury to OWNERl(S) horse(s), tack, equipment, vehicle and trailer are not covered by TRAINERS insurance. If interested in such coverage the owner must carry his/her own insurance to cover said property.

ATTENTION: Under Michigan equine activity liability act, an equine professional is not liable for an injury to or death of a participant in an equine activity resulting from an inherent risk of the equine activity.

RELEASE OF LIABILITY: I undersigned OWNER/GUARDIAN, agree to hold harmless and release the TRAINER(S), owners, agents, employees , officers, members, premises, owners, insurers, and affiliated organizations from legal liability due to TRAINER’S ordinary negligence; and agree to accept in such event to bring no claims, demands, actions and causes of actions, and/or litigation, against either LASTING IMPRESSION HORSEMANSHIP, LLC or hosting facility, for any economic and non-economic losses due to bodily injury/harm, death, property damage, as well as injury/harm or loss by death of boarded, horses in training, or animal(s) used for lessons.

BY SIGNING BELOW, I ACKNOWLEDGE I HAVE READ AND AGREE TO ABOVE AGREEMENT AND TERMS AND UNDERSTAND THE CONTRACT IS LEGALLY BINDING ACCORDING TO THE STATE LAWS OF MICHIGAN.
